SELF DEFENCE

  1. Right to Self-Defense: Individuals have the right to protect themselves and others from imminent and serious threats using necessary force. This right, recognized worldwide, allows individuals to act when immediate protection is required, and legal repercussions generally do not apply if the force used was proportional and necessary.
  2. Imperfect Self-Defense: When a person acts on an honest but unreasonable belief that force is needed, this is known as “imperfect self-defense.” While it doesn’t fully excuse the use of violence, it can mitigate charges and penalties. Not all jurisdictions recognize this concept.
  3. Indian Self-Defense Laws: In India, self-defense is governed by Sections 96-106 of the IPC, which protect individuals from legal consequences when defending themselves or others from serious harm or property crimes. Case law emphasizes that the force used must be reasonable and proportional to the threat faced. Reference-https://jotwani.com/the-self-defense-law-in-context-with-the-indian-laws/
